Driving - you're likely looking at a bad transmission computer governor. They will start in 2nd or 3rd or do all kinds of crazy things when bad. Do some searches on this site to find more info

It's all speculation without gauges on the system to see what the pressure is when the compressor cycles. Your symptoms are exactly what would happen with low refrigerent.
