Neither myself or my father has any experience here, but I know someone here has some great information on this subject. My father has a 2008 Chrysler Town and Country but the payments are a bit steep right now as he has not been able to find work in a few years (Pretty much lost his job around the time the car was purchased). This van is a mechanical nightmare, the rotors in the front (Mainly the front passenger one) keep going bad and eventually causes the tires in front to go bad while the tread is still new! The van sucks petrol like you would not believe (More than the listed MPG says it does) and he is looking for a way to get out of this van and maybe get a used 1999 Mercedes ML350 for bout 5-6k?

I have a 2010 grand caravan with similar problems and others. The brakes are a known problem. I am considering selling so I took it to Carmax for an appraisal and got a pretty fair offer. You may want to consider that option.

If your dad is short of ready cash then an older MB may not be the way to go. It may be a $5k car to buy, but the parts are still from a $50k car. And as any mechanic will tell you the skills are the same to work on a Benz or a Buick, you can just charge more for the Benz work. If he needs a small SUV what about a Jeep?

Just recently went through a similar situation.

First talk to your bank. They will tell you what options you have for selling it. Some banks even have in house marketing to help re-sell your car. I was dealing with Wells-Fargo which only permits family transfers. Luckily my dad was looking for a truck and i sold him my 06 GMC 3500 for the value of the loan. Wells paid off my exsisting loan and wrote him a new one for whatever i had left in payments. It was a win win for everyone.

Bottom line is call the bank. You won't be able to do anything without them. Even if you do find a buyer for your car it can take weeks sometimes longer to get your title or a lien release from the them even after they are paid making most buyers walk. They know times are tough for everyone and some are willing to work with you.

Call the bank, even if the existing loan is through Chrysler and not a bank? He is concerned this pile of crap Chrysler will turn out like his 1993 Mitsubishi Expo LRV Sport and rapidly become a succubus on his already limited budget for automotive repair and tires..

Yes if your looking to get out of it. Call Chrysler financial or whatever lending institution is holding your note.

Isn't an 08' under any kind of warranty? How about going the lemon law route? A private party sale will always bring you more money than selling to a dealer, the dealer has to leave room for his profit.

Never considered the Lemon Law.. We have the repair documents, how would we get a refund for the car via this law?

I don't have any real information on the law itself but I'm sure you can get it from your consumer affairs dept. or online. Sorry I don't have it for you.
